TIMING: The Marinela^® Feed Your Dreams Instant Win Game (the “Promotion”) starts on June 17, 2024 at 8:00 a.m. Eastern Time (“ET”) and ends on August 31, 2024 at 11:59 p.m.ET (“Promotion Period”).

ELIGIBILITY: The Promotion is open to legal residents of the fifty (50) United States and the District of Columbia who are 13 years of age or older as of date of entry. Eligible minors must obtain their parents or legal guardians permission prior to participating. Employees of Bimbo Bakeries USA (“Sponsor”), Retail Sports Marketing, Inc. (RSM), their subsidiaries, distributors, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Void where prohibited by law. Promotion is subject to all applicable federal, state and local laws.

HOW TO ENTER: During the Promotion Period, scan a QR code on point of sale materials or media videos or visit the Promotion landing page at www.feedyourdreamswithMarinela.com (the “Website”) and follow the directions provided to complete the online form with your first name, last name, mailing address, email address and submit to receive one (1) game play (each, a “Game play”). Game plays must be submitted during the Promotion Period in order to be eligible. One (1) Game play per person using only one (1) valid email address per day. Game plays submitted in excess of the above stated daily limitation will be void. Game plays generated by script, macro or other automated means and Game plays by any means which subvert the entry process are void.

Sponsor is not responsible for incorrect, inaccurate or incomplete entry of information by entrants; lost Game plays or transmissions, interrupted or unavailable network, server, or other connections; scrambled transmissions or other errors or problems of any kind whether mechanical, human, or electronic, technical malfunctions or the computer hardware, software, or any combination thereof; or problems associated with any virus or any other damage caused to entrants’ systems.

HOW THE PROMOTION WORKS: All Promotion prizes are randomly seeded at predetermined designated winning times (each, a “Winning Time”) throughout each day during the Promotion Period. The first entrant to submit a Game play at a Winning Time will be the potential winner of the specified prize. If no entrant submits a Game play at a Winning Time, the first entrant who submits a Gameplay after the Winning Time will be the potential winner of the specified prize. If an entrant is a potential winner of a prize, he/she will immediately receive an on-screen message informing them of the applicable prize and they may follow the instructions provided to claim the prize, which will include a prize confirmation email to the email account used to enter the Promotion. If an entrant does not receive a winning message, they are not the winner of a prize. Confirmed winners will receive their prize after the Promotion has ended via mail following verification of eligibility and confirmation of winning Game play.

Approximate Retail Value (“ARV”) of each prize package: $320.

TIER 1 WINNERS (25): Twenty-five (25) Tier One winners will each receive one (1) pair of earbuds, one (1) pair of Marinela socks, one (1) clear fanny pack, one (1) stress ball, one (1) sheet of Marinela stickers, and one (1) full-value coupon, redeemable for one (1) Marinela product. ARV of each prize package: $240.

TIER 2 WINNERS (50): Fifty (50) Tier Two winners will each receive one (1) fabric clip Bluetooth speaker, one (1) stress ball, one (1) sheet of Marinela stickers, and one (1) full-value coupon, redeemable for one (1) Marinela product.  ARV of each prize package: $100.

TIER 3 WINNERS (75): Seventy-five (75) Tier Three winners will each receive one (1) pair of Marinela socks, one (1) sheet of Marinela stickers, and one (1) full-value coupon, redeemable for one (1) Marinela product. ARV of each prize package: $35.

TIER 4 WINNERS (100): One Hundred (100) Tier Four winners will each receive one (1) stress ball, (1) sheet of Marinela stickers, and one (1) full-value coupon, redeemable for one (1) Marinela product. ARV of each prize package: $15.

ALL PRIZES: The total ARV of all prizes awarded throughout all prize tiers is: $16,725.

Limit one prize per person, per valid email address per day. All prizes will be awarded after the Promotion Period. No substitution or transfer of any prize or election of cash in lieu of any prize by any winner will be permitted. Sponsor reserves the right to substitute any prize of equal or greater value. Prizes are nontransferable. All federal, state, and/or local taxes are the sole responsibility of the winners.

Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to deliver the notification to selected Winner. The total prizes will be shipped directly to the mailing address the winner provided on their entry form. If a selected winner has moved to a different address, it is the sole responsibility of the selected winner to notify the Sponsor or designated agent of the selected Winner’s new address. In the event of a dispute over the identity of the selected Winner, the Winner will be deemed to be the Authorized Account Holder of the email account/address used to enter the Promotion. “Authorized Account Holder” is defined as the natural person who is assigned to an email account/address. Sponsor is not responsible for any undeliverable prize deliveries due to change of address. By accepting and/or using prize, except where prohibited, Winners gives Sponsor, RSM and its designees the rights to use Winners’ name, voice, likeness, prize information, city and state of residence, video, voice, any comments, testimonials, or other feedback  related to the prize, whether written or oral, in advertising, trade, or promotion, without further compensation worldwide in perpetuity and in any form of media, now known or hereafter developed, including the Internet, unless prohibited by law.

PRIZE CONDITIONS: All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winners. Prize awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winner may not substitute any prize. Winner may assign or transfer prize only with the approval of the Sponsor, which may only be done at the Sponsor’s sole discretion. Winners may not redeem any prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. All prize details are at Sponsor’s sole discretion. Exact make, model, color and size of merchandise prizes to be determined by Sponsor, in their sole discretion. Coupons must be surrendered at time of redemption. Coupons are subject to certain terms and conditions specified by Sponsor. Coupons expire on date specified on each coupon. Coupons may not be used online or in conjunction with any other offer or discount. Valid only in the U.S.A. and are void where prohibited.

‍GENERAL CONDITIONS:  By participating, each entrant (and if an eligible minor, their parent or legal guardian on their behalf) agrees: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Promotion; (b) to release, discharge and hold harmless Sponsor and their respective affiliates, subsidiaries, distributors, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Promotion or any Promotion-related activity or the acceptance, possession, use or misuse of the prize; and (c) to the use of his/her name, voice, performance, photograph, caption, entry, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use. MISCELLANEOUS: In the event more prizes for any prize tier are claimed than are intended to be awarded, Sponsor reserves the right, as applicable, to award the stated prizes for the applicable prize tier(s) in a random drawing from among all valid prize claims received for the applicable prize tier(s). In no event will Sponsor be liable for more than the stated number of prizes listed in these Official Rules. Released Parties are not responsible for postage-due mail or for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled game plays, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of game plays, the announcement of the prize, or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Promotion or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Promotion or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated game plays will be void. Should any portion of the Promotion be, in Sponsor’s sole opinion, compromised for any reason, including virus, worms, bugs, non-authorized human intervention, epidemic, pandemic, an Act of God, or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of game plays, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Promotion (or portion thereof) and, if terminated, at its discretion, select the potential winners in a random drawing from among all non-suspect, eligible game plays received prior to action taken. ARBITRATION: Except where prohibited by law, as a condition of participating in this Promotion, participant (or participant’s parent or legal guardian, if a minor) agrees that (1) any and all disputes and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and participant further waives all rights to have damages multiplied or increased.

FORCE MAJEURE: Sponsor reserves the right to modify, extend, suspend, or terminate this Promotion if it determines, in its sole discretion, that this Promotion is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of this Promotion as contemplated herein. In the event an insufficient number of eligible Game plays are received and/or Sponsor is prevented from awarding any prize or continuing with this Promotion as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state/provincial or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then Sponsor shall have the right to modify, suspend, or terminate this Promotion.

FORCE MAJEURE: Sponsor reserves the right to modify, extend, suspend, or terminate this Promotion if it determines, in its sole discretion, that this Promotion is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of this Promotion as contemplated herein. CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the Commonwealth of Pennsylvania, USA.
